By submitting this
application form or clicking the Azarmoney.com “I Accept”
button, you hereby agree to strictly abide by the terms and
conditions specified in this agreement. Moreover, any usage
of marketing tools or accepting any commission, reward or
bonus whether or not mentioned in this agreement will be considered
as your acceptance to follow the agreement to all the terms
and conditions set out in this agreement and becoming a part
of Azarmoney.
For your information, the terms "we" and "us"
refer to Azarmoney.com and "you" and "Webmaster"
/”Affiliate” refers to the party to the contract
formed by the agreement to these Terms and Conditions. The
"Client"/”Partners” are any company
that has contracted Azarmoney to promote their Casino(s).
As per the contract, you possess the non-exclusive right to
direct users ("Visitors") from your site or sites
to the Client's websites and are entitled to get commissions
and referral bonuses in return as stated below. Please go
through the below rules and regulations to get a thorough
understanding of our principles and policies.

|
ENROLLMENT |
|
|
As per our agreement which shall commence
on your agreement as specified above, and shall end when either
we or you notify the other, by email, of the termination of
this Agreement, you are bound to display a banner or banners
on your site (the "Webmaster site") as a hyperlink
in order to direct Visitors from the Webmaster Site to the
Client's Sites, using distinct URLs supplied by us, Azarmoney.com
exclusively for linking (the "Supplied Banners").
The Client's banners shall be displayed significantly
similar to any other sales link on the Webmaster site, and
would require Azarmoney.com' prior written approval, if the
Webmaster displays or provides visitors any descriptive information
regarding any vendors whose banners are displayed on the Webmaster
site.
The relationship between both parties are non-exclusive;
consequently, the Webmaster shall be entitled to display the
banners of, and provide links to sites of other companies
through the Webmaster site, and Azarmoney.com shall be entitled
to make the Client's banners available through online and
other services than the Webmaster site.

Definitions |
|
1.1 |
Azarmoney.com’s website is located at http://www.Azarmoney.com.
It’s a casino affiliate program |
|
1.2 |
An affiliate is like a valued partner of our
company representing us via website or email. |
|
| 1.3 |
Player(s) is a person who enters the Site via
a unique tracker code and works for an affiliate and has deposited
a certain amount of money to play. |
|
| 1.4 |
Tracker(s) is the unique tracking URL used to
track affiliate’s efforts and estimate their advertising
Revenue. |
|
| 1.5 |
Banners, Text Links, pop ups are some of the
graphical artwork or text that will direct the visitor to our
site's home page at http://www.Azarmoney.com. |
|
| 1.6 |
Deposit(s) are the amount the player would put
to play. |
|
| 1.7 |
Redeem(s) is funds withdrawn or cashed-out by
Players from their Site account. |
|
| 1.8 |
Casino Net Revenue means the sum of Deposits
less Redeems generated on your Tracker(s) based solely on our
log files. |
|
| 1.9 |
Revenue is the percentage of Casino Net Revenue
due and payable to you, on the first week of every month based
according to our systems data. |
|
| 1.10 |
CPA Structure is based on a one-time payment
in which the affiliate is paid for a depositing player that
he directed to Azarmoney. |
|
| 1.11 |
"Spam" refers to emails and messages
which contain false or misleading statements, unsolicited mail. |
|
| 1.12 |
Sub-Affiliates refer to all traffic referred
by you. |
|
| |
|
|
| 2. |
Our Rights and Obligations |
|
| |
|
|
| 2.1 |
Registration and tracking |
|
| |
Azarmoney.com will register the players for the
affiliates and will track their play and performance using our
secure tracking system. We will provide time to time report
on client tracked player activity supplied by affiliates. We
also reserve the right to reject customers (or to close their
accounts) if necessary to comply with any requirements we may
periodically establish. We will provide remote online access
to reports of customer activity and the Advertising Revenue
generated. |

| 2.2 |
Marketing tools |
|
| |
A variety of graphics like banners and text link
will be provided to the affiliate with the non-exclusive, non-transferable
rights, during the term of this Agreement, to exclusively use
in their site to attract visitors including the right to copy,
transmit, distribute, display and perform both privately and
publicly.
Azarmoney.com and/or the Client will exclusively provide varieties
of banners, links, graphics, site name, and more to the Webmaster
for the purpose of enclosure on the Webmaster's site from time
to time (collectively, the "Client's Material") and
for the specific purposes authorized above. Azarmoney.com and
the Client authorize the Webmaster to, publicist, advertise
and promote their respective promotional material in all the
possible way. The Webmaster shall not modify nor misrepresent
the copywriting of promotions in any case.
Azarmoney.com and the Client also authorize the Webmaster to
remember that during their advertising and promotions the fact
that the Azarmoney.com and Client's sites are accessible through
the Webmaster site provided that any such statement:

(a) does not include any trademarks, symbols
and/or other indication of origin of Azarmoney.com or the Client
other than Azarmoney.com or the Client's Casino(s) name and/or
site names in a non-distinctive typeface (specifically, not
the typeface used in the logo design of any of Azarmoney.com'
or the Client's mark); |

(b) does not vilify Azarmoney.com or the Client,
its products, services, or affiliates. All use of the Azarmoney.com
or Client's Materials will benefit the Client and shall not
create any rights, title or interest in them for the Webmaster. |
|
| |
The Client shall always own and possess all right,
title and interest (including without limitation, all rights
provided under the law of copyright and trademark) in and to
the Client's Materials and all names, trademarks, service/design
marks, symbols and/or other indication of origin therein throughout
the world and in eternity, subject to the permissions granted
in this Agreement. |

| 2.3 |
Payment |
|
| |
We are obliged to pay our affiliates their respective
share of revenue based on the earnings and deposits made by
players directed from affiliate’s site after they open
an account with us and based on Deposits they make for real
money or on a CPA basis as per the terms of each individual
client’s program. |
|
| |
|
|
| 2.4 |
Modification |
|
| |
The terms and conditions mentioned in this agreement
can be modified at any time and in our sole discretion, by posting
a change notice or a new agreement on our site which will be
surely notified to you. |
|
| |
The current available commission scheme, fee
schedules, and affiliate Program rules are also subjected to
change. |
|
| |
The modification which is not acceptable to you
may lead to termination of your agreement with us otherwise
it will be considered as acceptable and continuation with us. |
|

|
|
| 3. |
Your Rights and Obligations |
|
| 3.1 |
Agreement and termination |
|
| |
By accepting this agreement, you have agreed
to work for us and follow all rules and regulations strictly
and to its entirety and shall terminate when either of the party
- you or us notify the other, especially by email regarding
the termination of this Agreement. |
|
| |
|
|
| 3.2 |
Linking to Azarmoney.com |
|
| |
Your agreement to these terms and conditions
bind you to create a unique link from your site to Azarmoney.com.
Therefore becoming eligible to use all our marketing tools and
materials to attract visitors and thereby earning more .The
agreement will be terminated immediately in case of spamming
or advertising our casino in any other unauthorized way. In
that case no claims will be accepted. |

| 3.3 |
Recruiting Players |
|
| |
Under this agreement you are responsible to bring
visitors and direct customers to our site and services by using
all the available resources from the Azarmoney.com. All the
marketing materials should be used exclusively and extensively
to attract the customers to the client sites. |
|
| |
|
|
| 3.4 |
Layouts |
|
| |
You shall use only approved and authorized banners
and other materials and should not change the appearance and
syntax/code of the links. It should be attractive and appealing
to the visitors. Any change or modification unavoidable should
be informed to the Azarmoney at the earliest. You may only use
banners from Azarmoney.com banner farm, located in the Affiliate
area. |

| 3.5 |
Good faith |
|
| |
All the traffic generated by you should be trustworthy
and they should not cause any damage to us knowingly or unknowingly
which may otherwise lead to withholding your part of revenue.
Any fraudulent activity directed to Client's site via your link
will retain the right to retract the commissions paid to you
at any time. In this situation, our decision will be deemed
final and no correspondence will be entered into. Consequently,
we reserve the right to retain all the amounts due to you under
this Agreement, if we are confident that such traffic has been
caused with your very knowledge. |

Besides, if the players generated by you are
“Bounty Hunters,” who only take advantage of the
Welcome Bonus and then leave the casino, we reserve the right
to suspend the affiliate account without prior communication
until further notice and we will have the right to retain all
amounts due to you under this Agreement. |
|
| |
|
|
| 3.6 |
Responsibility for Your Site |
|
| |
You will be solely responsible for the development,
operation, maintenance, and contents of your site. We will not
be liable for it in any way and in case of any misdeed we may
be compelled to close your account or to transfer your earnings
to the original content creator. |
|
| |
We disclaim all liability for above said matters.
Further, we will be held harmless from all claims, damages,
and expenses (including, without limitation, attorneys' fees)
relating to the development, operation, maintenance, and contents
of your site. |
|
| |
|
|
| 3.7 |
You shall not authorize, assist or encourage
any third party to attempt advertising, promoting or marketing
Azarmoney.com Banners and Text Links within Restricted Jurisdictions.
In which case serious action will be taken leading to termination
of your account forever. |
|
| |
|
|
| 4. |
Fees |
|
| |
|
|
| 4.1 |
Commission Structures and Multi tier (Referral)

Azarmoney.com offers you one of the most competitive
and best commission structures. The commission is based on the
net revenues generated by the affiliate’s players for
different casino clients and you can earn profit from the players
for lifetime as long as their account remains active. |

Under the referral program, you shall be entitled

Payment |

We will pay you timely the Affiliate commissions
on a monthly basis and fast payments are made on the first week
of every month with multiple payment options for users by Neteller,
Money bookers, Click2pay, Wire and check. |
|

If you fail to achieve the amount of minimum
$50 Affiliate commission on a certain month, the earned amount
will be forwarded to the next calendar month.
All payments will be due and paid in either Euros, US Dollars
or Pounds Sterling, depending on the preferences you have selected
upon joining the program. If the account is negative, you will
not be expected to pay Azarmoney.com.
Advertising Revenue will be based upon our good faith calculation
based on our statistics and reports.

| 4.3 |
Fraud |
|
| |
Any unauthorized dealing with the earnings or
the right to use the materials or the power provided by us or
inappropriate use of our principles and policies, website and
visitors, will not be acceptable at all and all agreement will
be terminated. We believe to keep good faith and strict adherence
to our principles and policies. |
|
| |
|
|
| 4.4 |
Charge-backs |
|
| |
A charge-back is an un-collectable credit card
transaction from the CC companies as a result of customer non-payment
or fake credit card use. As per our rule, 50% percent of all
charge back amounts will be deducted from affiliate’s
payment and the charge back fees will be paid to CC companies
by Azarmoney. |
|
| |
Chargeback’s is nothing but the outcome
of a purchase transaction, where a customer, credit card Company,
or other third party payment provider reverses a charge in relation
to that particular transaction. It can happen due to fraudulent
activity, insufficient funds, or other reasons; the reversed
amount will be deducted as stated above in the month they are
realized and not necessarily in the month that the transaction
occurred. |

Here, fraudulent account can be defined as a
customer account, which has chargeback and never completed a
successful transaction. |
|
| |
|
|
| 4.5 |
Affiliate Rewards Program |
|
| |
Affiliates who are active and in good rapport
with Azarmoney.com are eligible to participate in this reward
program and thereby they agree to bind by the decisions of Azarmoney.com,
which will be considered as final and binding in all respects. |
|
| |
Azarmoney.com reserves the right to terminate
any and all Affiliate rewards programs for any cause, including,
but not confined to, unable to carry out the planned program
in case of corruption of administration, security, integrity,
or proper conduct of the Rewards Program or any other reason
of infection by computer virus, unauthorized intervention, fraud,
technical failures etc to mention a few which is beyond our
control. Azarmoney reserves the right to cancel, postpone, close,
modify or withdraw the Reward Program without prior notice and
without liability to the Affiliate. |

Any taxes, fees, and surcharges on Rewards are
the sole responsibility of the prizewinner. |
|
| |
|
|
| 5. |
Term and Termination |
|
| |
The terms of this Agreement will commence the
moment you join us and create a unique link to our site and
will be continuous until and unless either party notifies the
other in written to terminate the Agreement via email, in that
case this agreement will be terminated immediately. TERMINATION
IS AT WILL, FOR ANY CAUSE, BY EITHER OF THE PARTY. |

| 5.1 |
Post termination |
|
| |
Once agreement is terminated, you are responsible
to remove our banners etc from your site and deactivate your
link from our site. All rights and licenses shall be immediately
terminated. |
|
| |
Failure to do so will make you ineligible to
earn the advertising revenue otherwise owing to you on termination. |
|
| |
Any referral fees due to you on or prior to the
date of termination will be paid at the sole discretion of Azarmoney.
After the termination or failure to fulfill your obligations
and responsibilities will make you ineligible to any further
referral fees. |
|
| |
Your final payment may be withheld for a reasonable
time to ensure that the correct amount is paid to you. |
|
| |
Any continuation of activity (generation of revenue)
from customers after termination will not be considered as a
continuation or renewal of this Agreement or a waiver of termination. |
|
| |
You are not allowed to disclose any confidential
information and should release everything in your possession,
custody and control related to us and our clients. We will stop
all uses of any trade names, trademarks, service marks, logos
and other designations of our clients. |
|
| |
Prior to termination, both the parties (You and
us) will be released from all obligations and liabilities to
each other, except with respect to those obligations which by
their nature are designed to survive termination, as set out
in this Agreement. However, termination will not relieve you
from any liability arising from any breach of this Agreement
occurred prior to termination. |
|
| |
|
|
| 5.3 |
Confidential Information |
|
| |
During the term of this Agreement and thereafter,
the Affiliate may have access to certain classified, confidential,
proprietary and sensitive information concerned with the business,
operations, rules and regulations of Azarmoney.com and its Clients’.
The Affiliate should hereby agree not to release the confidential
information to any third party or to use the information in
an unauthorized manner without any prior written consent directly
from Azarmoney. The consent obtained will be deemed to further
the purposes of this Agreement by the Affiliate. |

| 5.4 |
Risk Allocation |
|
| |
Both parties will not be liable to each other
or to any person claiming rights derived from the other party's
rights for incidental, indirect, consequential or typical damages
of any kind - including lost of revenue or profits, loss of
business, or loss of data -arising out of this Agreement regardless
of whether the party liable or allegedly liable was informed
earlier or in fact knew of the possibility thereof. |

| 5.5 |
Commercial Use Only |
|
| |
This business opportunity is merely for commercial
purpose only, and you, your family members, friends, relatives
may not make deposits, directly or indirectly to falsely increase
the Revenue payable to you otherwise it would lead to the termination
of your account from Azarmoney. |
|
| |
|
|
| 5.6 |
Liability |
|
| |
The Affiliate hereby accepts that the purchase
or use of any services offered by the Client through the Client's
sites or through its software will not be supported or endorsed
by Azarmoney, nor does it guarantee the quality or results of
any such service or compliance with any law or regulation. |
|
| |
Moreover, we will not be liable for any indirect,
or consequential damages
or any loss of revenue, profits, or data as per this Agreement
or the Affiliate Program,
even if we have been advised of the possibility of such damages.
Further, our comprehensive liability arising with respect to
this Agreement and the Program will not exceed the total Advertising
Revenue paid or payable to you.
Nothing in this Agreement shall be interpreted to provide any
rights, remedies or benefits to any person or entity not a party
to this Agreement.
Any liability out of this Agreement shall be compensated exclusively
from the marketing fee generated and is limited to direct damages.

| 5.7 |
Acknowledgement of No Warranty |
|
| |
Neither party warrants that their respective
websites will function as expected or without interruption,
error or defect or that any revenue to either party will result
from the activities mentioned in this Agreement including warranties
of merchantability or fitness for a particular purpose or warranties
against breach of any intellectual property rights not specifically
specified. |
|
| |
|
|
| 6. |
Disclaimers |
|
| |
It is our responsibility to declare taxes from
our Affiliates profits, according to the country's regulations.
An institutional bank located on the island of Antigua issues
the affiliate's payments; therefore, Azarmoney will not issue
any forms related to this matter. |
|
| |
We also make no implied warranties or representations
with respect to the Affiliation Program, Azarmoney.com or regarding
the marketing fee payment policy , mode of operation, warranties
of fitness, merchantability, legality, non-infringement, or
any implied warranties arising out of a course of performance,
dealing, or trade usage).
|
|
| |
Moreover, we do not assure that the operation
of our site will be uninterrupted or error-free and will not
be liable for the outcome of any interruptions or errors. |
|
| |
|
|
| 7. |
Miscellaneous |
|
| |
|
|
| 7.1 |
Governing Law |
|
| |
The interpretation, performance or any breach
of this Agreement shall be interpreted in accordance with, and
all questions regarding this shall be determined by, the internal
substantive laws of Antigua and Barbuda. |
|
| |
Any action relating to this Agreement must be
brought into the Spain’s law and the Affiliate permanently
consents to the jurisdiction of its courts. |
|
| |
|
|
| 7.2 |
Non-Waiver |
|
| |
Our employees, officers or agents may not verbally
alter, modify or waive any provision of this Agreement. Any
failure from our side to enforce your performance of any provision
of this Agreement will not constitute a waiver of our right
to consequently enforce such provision or any other provision
of this Agreement. |
|
| |
|
|
| 7.3 |
Waiver |
|
| |
As per this agreement, no waiver of any breach
of any provision shall constitute a waiver of any prior, concurrent
or consequent breach of the same or any other provisions hereof,
and no waiver shall be effective unless it is in written and
signed by an authorized representative of the waiving party. |
|
| |
|
|
| 7.4 |
Single Account |
|
| |
If Azarmoney discovers that the affiliate is
operating more than one site with client Casino(s), this agreement
shall terminate and the affiliate’s rights to commissions
and referral bonuses will be forfeited. Several sites can be
registered to the one account; however, the usage of any casino
banner on a new site, under the Azarmoney Affiliates Program,
MUST be reported by the affiliate and cleared by the Azarmoney
Support Team beforehand, and failure to do so may result in
the termination of the affiliate's account. All rights to commissions
and referral bonuses will also be forfeited by the web master
in this situation. |

|
|
| 7.5 |
Independent Contractors |
|
| |
According to this agreement, Azarmoney and the
affiliate are independent contractors and nothing herein will
lead to create a partnership, joint venture, or agency relationship
between Azarmoney and the affiliate. Neither party has the authority
to enter into Agreements of any kind on behalf of the other
party. |
|
| |
|
|
| 7.6 |
Affiliate Account and Player Account Relationship |
|
| |
Affiliates are permitted to establish player
accounts with our clients and venture real money on any game
offered. However, Azarmoney prohibits affiliates from registering
these accounts with the program as there will not be any commissions
paid out to affiliates for such activity and affiliates caught
supplementing their commissions by generating play through unqualified
accounts may lead to the forfeiture of all commissions earned
for a full month. Continuation of this practice may terminate
you from the Azarmoneys' program indefinitely. |

| 7.7 |
Assignment |
|
| |
Under this agreement, Azarmoney may not assign
this Agreement or any of its rights or delegate any of its duties
without prior written consent of the affiliate. Without such
consent any alleged assignment or delegation shall be considered
null and void. It may even lead to termination of your own account
from our site forever. |
|
| |
|
|
| 7.8 |
Spam |
|
| |
Spam will not be accepted at all and it may even
lead to closing your account and all funds due will be withheld.
For your information, to deal with spam generated mail, our
clients may be liable to incur the expenses which will be deducted
from your account. |
|
| |
Under such circumstances, the amount determined
by the client will be fair and considered final and acceptable
based on good faith and such amount will be deemed to be collectable
by law and will be supposed to be accepted by you as fair and
reasonable and as agreed to by registration as an affiliate
of Azarmoney. |
|
| |
In case of insufficient funds in your account,
we have the right to find other options for obtaining payment
including claim against your unpaid amounts. |
|
| |
|
|
| |
|
|
| |
THE AFFILIATE HEREBY ACKNOWLEDGES THAT HE/SHE
HAS INDEPENDENTLY ASSESSED THE BENEFITS OF PARTICIPATING IN
THE AZARMONEY CASINO AFFILIATE PROGRAM AND STRICTLY AGREED TO
ABIDE BY THE RULES AND REGULATIONS THEREBY.IT ALSO IMPLIES THAT
THEY ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE, OR STATEMENT
OTHER THAN AS SPECIFIED IN THIS AGREEMENT. |
